Could moviegoers be getting shortchanged on beer?
US cinema chain Cinemark has been accused of swindling customers by shortchanging them with a 24oz beer cup that only holds 22oz of liquid.
A new class-action suit filed by Texas resident Shane Waldrop alleges that the US$8.80 ‘large’ draught beer he bought during a film screening at a Cinemark cinema could not contain the amount of beer it purported to.
As reported by THR, Waldrop’s class action lawsuit this week claimed the chain had committed “negligent misrepresentation, fraud, unjust enrichment and a violation of Texas’ Deceptive Trade Practices Act”.
As such, Waldrop and his attorneys are now seeking an end to the labelling, as well as a “disgorgement of profits”.
In a recent report detailing the lawsuit, THR added that the issue could go further and pointed out that this is because: “the lawyers for Waldrop also seek to represent other purchasers of the 24oz cup”.
This could incriminate other businesses who purchase cups from the same supplier.
According to reports, the complaint stated: “The size of the container in relation to the actual volume of the product contained in it was intended to mislead the consumer into believing the consumer was getting more of the product than what was in the container by a twelfth.”
The lawsuit could potentially also lead to further investigations being made into cinema and theatre cup serving sizes and the measures of beverages which they contain when filled to capacity.
